Registration procedure

Once you have chosen the property that suits you and made the final decision to purchase, you can begin registration!

Stage 1. Conclusion of a purchase and sale agreement

At the first stage, the seller and buyer enter into an agreement. It contains information about the parties to the transaction, the property (layout, construction features, dates of commissioning, etc.), terms and conditions of payment for the transaction, and the responsibilities of the parties.

When signing the contract, the buyer only needs a foreign passport. The document is in triplicate and in several languages, for example, Turkish and English.

The agreement itself, even certified by a notary, does not have the force of a document certifying the transfer of ownership. To do this you need to obtain a TAPU (certificate of ownership).

In Turkey, there is a title system for registering rights to real estate, that is, government bodies represented by the Cadastral Department draw up property documents, guaranteeing the purity and legality of transactions at the state level.

Notaries do not have the right to independently register purchase and sale transactions.

When signing the contract, the buyer makes a deposit to reserve the property – 10-20% of the price of the property.

 

Stage 2. Obtain an independent expert assessment of the purchased property.

Typically, the assessment procedure takes 1-3 business days. To be paid by the buyer.

 

Stage 3. Preparation of documents for registration of TAPU.

TIN. The obtaining procedure is simple and takes a few minutes. To obtain a TIN, you need to come to the district tax office (vergi dairesi), present your passport and write an application. You can also get a tax number online.

Stage 4. Obtaining a certificate of currency exchange from the bank.

 

To do this, you will need to come to the bank with a passport, tax number, TAPU for the apartment you are going to register. A bank employee will open an account for you. You deposit currency (euros or dollars) in the equivalent of the cadastral value of the apartment into this account, convert it into lira and receive a certificate.

 

Stage 5. Obtaining TAPU.

The transfer of ownership from the seller to the buyer takes place at the Cadastral Office in the presence of the buyer, seller and sworn translator.

The settlement between the buyer and the seller also takes place at the Cadastral Office.

 

Stage 6. Registration of related documents for the new owner

Earthquake insurance (mandatory).

Registration of meters for water and electricity.
